Evaluating Hotline Program Effectiveness Against DOJ & OIG Standards

In the U.S., the DHHS Office of Inspector General (OIG) has issued compliance program guidance related to the seven elements of an effective compliance program, much of which focuses on confidential compliance communication channels and hotline operations.

The DOJ has its own “Evaluation of Corporate Compliance Program” guidance to assist prosecutors in evaluating whether a “corporation’s compliance program was effective at the time of an offense for purposes of determining the appropriate (1) form of any resolution or prosecution; (2) monetary penalty, if any; and (3) compliance obligations contained in any corporate criminal resolution.”  It asks hundreds of questions for prosecutors to answer about compliance programs, many of which include hotlines and confidential reporting.
